OROP : Doubts On OROP Notification Of 07 November 2015 - Brig CS Vidyasagar

Many veterans are ringing me up and posing many questions mistakenly assuming I am an authority on OROP.

 
Question No 1: “ I am PMR case. Do I get OROP?”
 
My Answer No 1. I can understand their anxiety as they might not have read the official statement on OROP released by spokesperson of Min of Def on 07 Nov 2015.
 
It has been amply made clear all those who took PMR (Pre Mature Retirement) are covered under OROP scheme. Only those who seek PMR in future will not be eligible. If you see PMR cases are mostly in Officer Cadre for many reasons such as supersession, medical problems, domestic compulsions etc.
 
The stand of the Govt of India during negotiation stage with representatives of ESM Associations agitating for OROP was that “ Your stand for OROP is that you retire at a younger age compared to your civilian counterpart. It is understandable. If Govt of India allows a Colonel to serve for 34 years (assuming he got his commission at the age of 20 years and retirement age being 54) and seeks PMR after 26 years’ service (26 + 7 years rank weightage) and leaves service before 8 years of his super-annuation why should he get benefit of OROP? See his course-mate who serves for 34 years though he is also superseded and works in in –hospitable places like Siachen and High Altitude Areas in North East, Sikkim and J &K and suffers in services how can he who served sincerely for 34 years and the one who ran away (IAF Flying branch officers who join civil air lines to draw astronomical salaries) with just 26 years’ service get the same pension under OROP. OROP will only be given to those who fulfil terms & conditions of the service. Since this condition is not knows to all PMR cases, Govt of India has taken lenient view and allow OROP to all such PMR cases. But from now onwards PMR cases will not get OROP. Choice is yours. Serve till your age of superannuation (for Officers) or as per terms and conditions (Sepoy to serve till 15 years) and get OROP or leave early for greener pastures and get normal pension.”
 
Well you may or may not agree to the stand of Government of India.
So all those PMR cases retired till issue of notification on 07 Nov 2015 are covered under OROP but future OROP cases WILL NOT be covered under OROP as per Govt notification.
 
Question No: 2 . “What is this Average of Maximum and Minimum of pension in calendar year 2013?”
 
My Answer No 2. Govt of India has been arguing that pension is dependent upon last pay drawn. The one who serves for maximum number of years gets more last emoluments drawn and hence his pension is more. For example in some Corps / Regiments/Service like IAF and Navy in certain branches one becomes Sub Maj earlier than in other Corps/branches/Service. Sub Maj can in Army can serve for 32 years. Suppose Sub Maj Ram Chandra from EME in a particular trade gets his promotion at the service of 22 years, therefore he serves as Sub Maj for 10 more years. His pay with increments as Sub Maj is high and his pension at the end of 32 years is more.
 
Compare this to another Sub Maj Kishan Ram of EME from some other trade who becomes Sub Maj at 28 years’ service. His service as Sub Maj is only four years. Hence his last drawn emoluments are less compared to Sub Maj Ram Chandra. When pension of two Sub Maj is not same, how can their pension in OROP w.e.f. Jul 2014 also be same? As it is very complicated to make OROP tables for each rank with number of years of service in last rank, we have arrived at a simple method of Averaging. Assume both Sub Majs are pre – 2006 retirees. Then we will see the pension in OROP as in 2013 is fixed by averaging maximum and minimum pension drawn by such Sub Majs of total service.
 
Assume MWO in IAF in 2013 with 32 years’ service draws pension of Rs 25,000 pm which is higest for that rank in that year. Call this as Maximum for Sub Maj with 32 years’ service. Then we see who drew least pension as Sub Maj or equivalent in 2013. If it is say Rs 23000 we call it as Minimum. Then the average is = (25000+23000)/2 = 24000. We will fix pension of all pre – 2006 Sub Majs with total service of 32 years at Rs 24,000.
This is my understanding and I could be wrong.

    2) Base year has been taken as average of 2013 & not of 2014 [ but 1/4/2014 was earlier dater ]
    3) OROP is Not from 1/4/2014 but now from 1/7/2014
    4) No increments from 1/7/2014 as it is not being paid from 1/4/2014.
    5) Veterans & widows efforts at JM have been wasted out / loss of money & time.

    6]one man judicial commission will be biased on similar lines

    7] in 7th cpc increment of 6% each year will not be available now thus a great loss

    B] SERVING ALSO HAVE BEEN CHEATED

    1] NO OROP TO FUTURE RETIREES

    [ Personnel who opt to get discharged henceforth on their own request under Rule 13(3)1(i)(b),13(3)1(iv) or Rule 16B of the Army Rule 1954 or equivalent Navy or Air Force Rules will not be entitled to the benefits of OROP. It will be effective prospectively.]

    2] DISGRUNTLED WILL BE FORCED TO SERVE

    3] LEVEL OF PERFORMANCE WILL GO DOWN

    4] STRUCTURE OF YOUNG ARMY WILL VANISH

    5] WILL BECOME POT BELLY ARMY ...LIKE COPS

    6] SERVING WILL TURN TO SLAVERY

    7] FORCED LABOUR[ SERVING] IS VIOLATION OF CONSTITUTION

    8] FUNDAMENTAL RIGHTS DENIED[ FREEDOM TO SERVE IS THUS DENIED

    9] NON PERFORMER WILL BE RETAINED

    10] THOSE WHO COULD NOT GET PROMOTION WILL BE FORCES TO SERVE UNDER JUNIORS.. COMMAND AND CONTROL WILL BE A PROBLEM

    II) Stop this street beggars attitude at JM.
    II) Do not Waste time & money on RLH
    IV) Knock door of SC to get real OROP

  3. 1)The doubt of min & max is not as easy as explained by Brig Vidyasagar.
    2) year starts from Jan & ends in DEC
    3) pension is not same in calender year.
    4) In July there is increment by 1.5%
    5)Thus in same calendar year there are 2 pensions
    One before first half year & second in second half of year.
    6) ideally & legally govt should take Jan pension as lower & max as Dec for same rank & same length of service.
    7) But babu's will not touch second half at all as they will have to dish out incremental pension.
    8) so min & max will be given as of first half year only
    A tricky gain again by babu's
