One Rank One Pension 

OROP Scheme

    One Rank One Pension (OROP) is a scheme that aims to provide equal pension benefits to retired military personnel who retired at the same rank and with the same length of service, regardless of when they retired. The concept of OROP is based on the principle of equity and justice, which aims to eliminate any disparities in pension benefits among retired personnel who served in similar ranks and for similar periods of time.

    One Rank One Pension (OROP) is a pension scheme aimed at providing equal pension benefits to retired military personnel who retired at the same rank and with the same length of service, regardless of when they retired.

    OROP scheme is based on the principle of equity and justice, which seeks to eliminate any disparities in pension benefits among retired personnel who served in similar ranks and for similar periods of time.
  

    This was first implemented in India in 1973. It was later modified in 2015 to provide for periodic revisions of pension rates based on the prevailing rates for personnel retiring in the same rank and with the same length of service.

    The One Rank One Pension scheme is important for retired military personnel, as it provides them with financial security and stability during their retirement years, and also boosts the morale of serving military personnel by assuring them that their retirement benefits will be taken care of in a fair and equitable manner.


Long Outstanding issue

The OROP scheme has been a long-standing demand of the Indian armed forces personnel and veterans, who have been advocating for its implementation for many years. We should accept “reasonably good” OROP scheme: Air Chief

New Delhi: Chief of Air Staff, Air Chief Marshal Arup Raha, on Wednesday asserted that One Rank, One Pension (OROP) scheme of the government is reasonably good and said that one should accept it.

"The OROP by the government is reasonably good. We should accept it. The anomalies are being resolved by one-judge committee. Some of the anomalies and the discrepancies which cropped up from the transition from the sixth to seventh pay commission have been resolved... others will also be resolved," he added.

Prime Minister Narendra Modi yesterday accused the Congress Party of betraying the jawans by not fulfilling the long-pending OROP demand in the last 40 years.

Addressing a parivartan rally in Dehradun, Prime Minister Modi said, "My Army jawans were demanding OROP for the last 40 years, the party that ruled the country then never thought of their demands."

"In reality, the budget for OROP is over Rs. 10,000 crore. Why did they (Congress) betray the Jawans by allocating 500 crore for this," he added.

He said the Centre was always clear that from day one that the Jawans must get their due and therefore, his government always stated that OROP will be a reality.

Defence Minister Manohar Parrikar earlier last month said 95 percent of veterans have already got the benefits of the OROP scheme and they are happy with it.

The scheme, announced in September 2015, is meant to ensure equal pension to servicemen who retired on the same rank and after the same duration of service, regardless of the year of retirement.

However, retired soldiers have been alleging that the government has not addressed their concerns fully about disparity in pension payments.

OROP demand, unheard for last 40 years, fulfilled by our govt.: Parrikar

Dehradun (Uttarakhand): Defence Minister Manohar Parrikar on Monday highlighted the Centre's role towards betterment of the army, stating that it was their government which fulfilled the demand of One Rank One Pension (OROP) Scheme, which had been otherwise been stuck for the last 40 years.

"The demand of OROP, which went unheard since last 40 years, was fulfilled by the Prime Minister Narendra Modi-led government," Parrikar said while addressing BJP's 'Parivartan rally' here.

Highlighting the amount of money to be given to the army veterans, Parrikar said, "Rs 7,500 crore every year and Rs. 11,000 crores worth arrears in form of compensation will be given."

Parrikar appreciated the government's efforts to get such a scheme passed with so many retired armed forced personnel's pension being stuck.

"It's not an easy task to manage a scheme involving 25 lakhs retired ex-servicemen. The list also includes those who fought during the second world war, and in 1947-48 war," he said.

The army veterans had demanded the implementation of the OROP scheme, meaning the same pension for same rank and length of service, which saw a number of protests staged by the ex-servicemen last year.

Following this, the government announced the implementation of the scheme last September.

Indian Armed Forces Ex Servicemen are Not Satisfied with OROP - Veteran Dilip Hiray

Below are the salient points where Indian Armed Forces are not Satisfied with OROP. These points are handed over to Raksha Rajya Mantri Dr Subhash  Bhamare during his visit at Malegaon on 28 Oct 2016.

1. OROP as per definition given by honourable Raksha Rajya Mantri is: Uniform pension to all defence pensioners irrespective of date of retirement for (a) same rank for (b) same length of service and for (c) same group. All benefits conferred on the present pensioners to be passed on to past pensioners.

2. Koshyari Committee Report defined OROP and approved by the two houses of the PARLIAMENT.

3. The Definition accepted by the NDA – II Govt. is to give same pension to all pensioners of same rank for same length of service irrespective of date of retirement. In simple words a Havildar of 20 years’ service of group Y retired in 1996 is to be given the same pension as another Havildar of same length of service and same group who retire in 2006 or 2016. That means unless pensions are equalised every year, it is not OROP.

4. OROP Vs One Time Increase. By giving pension equalisation once in five years NDA – II Govt. gave only One Time Increase by making pensions of all those who retired prior to 2013 i.e. from 1947 to 2012 equal to pension of those who retired in 2013 in the same rank, same length of Service and same Group X or Y. The UPA I & II Govt. also gave One Time Increase to JCOs and OR once in Jul 2009 and Sep 2012. For 11 lakh JCOs & OR pensioners, UPA Govt. gave Rs. 10,257 crores i.e. much more than what NDA – II is giving today.

5. Date of Implementation. NDA – II Govt. came to power after general elections held in Apr – May 2014. The financial year commences in Apr 2014 but OROP is implemented only with effect from Jul 2014 on the specious plea that they assumed power only on 26 May 2016. Did the NDA – II Govt. collect taxes from Jul 2014 or from Apr 2014?

6. Base Year. If OROP is to be implemented as per approval given by the Parliament in 2014 then the base year is to be 2014 and not 2013.

7. Average of Maximum and Minimum. The pension of JCOs and OR was always on the Maximum of the fitment table as per approval given by President of India in Circular 430 and Circular 501. Why then pensions have been fixed at Average of Maximum and Minimum thereby depriving arrears to all pensioners?

8. OROP Not available to Pre Mature Retirees. Armed Forces by structure are pyramidal with few vacancies in the top. Therefore when there are no promotional avenues available the soldiers must be permitted to leave after serving for minimum period to earn pension. Then why such premature soldiers are denied OROP?

9. Pension Fixation in OROP. Pension fixation adopted by Defence Accounts Department (DAD) is absolutely faulty. If they did not find a soldier of a particular qualifying service retired in 2013 but found one with longer service then they took the average of such longer qualifying service and reduced 3% per year to fix pension of junior in that rank i.e. Say Naik with 15 years has not retired in 2013 and Naik with 20 years retired in 2013. The average of maximum and minimum of Naik with 20 years’ service is taken and pension of Naik with 15 years’ service is reduced @ 3% per year to fix pension. Fine. But the same method should have been adopted if Naik of 24 years’ service is not found retired in 2013. They should have taken pension of Naik of 20 years’ service and increased pension of Naik with 24 years’ service @ 3% per year.

10. Lesser Disability Pension. All Soldiers who are disabled are given pension as per the rank they hold. Even if a Sepoy of 3 years is disabled his disability pensions is fixed as if he served for 33 years. But in OROP by linking length of service to the rank, soldiers with lesser service will get much lesser disability pension in OROP.

11. Lesser Special Family and Liberalised Family Pensioners. Earlier if a Sepoy was martyred in war or war like operations, his widow gets pension as per the rank. But in OROP by linking to the length of service widow of Sepoy who put in just 5 years’ service will get much lesser pension compared to another widow of Sepoy who put in 17 years’ service.

12. OROP Arrears Not Paid to 1.5 Lakh Pensioners. DAD personnel do not know ground realities. They directed banks not to pay OROP arrears if the PPO does not contain rank, length of service and Group X or Y. Group X pensioners get higher pension than Group Y. Since pensioners who retired in 1950s and 1960s did not have group endorsed in their Corr PPOs they are not paid OROP arrears by banks. When banks give details of such pensioners to PCDA (Pensions) Allahabad as per Appendix X of Circular 555, the PCDA have not given the group by searching the old PPOs and records held with them. Documents of pensioners cannot be destroyed and are to be kept in perpetuity. PCDAs have also not digitised their records in spite of getting funds since 1986. PCDAs are totally responsible for 1.5 lakh pensioners not getting arrears even after eight months.

13. While giving OROP they have purely considered only Army ranks not all the three services. JWO of y group having completed 32 years of service in IAF. While considering OROP of JCO in Army having 28 years of service maximum. In this way JWO lost 04 year service. It has happened with lot of personnel of this rank. It seems to be purely injustice.

14.  It's not only with JWO rank served for 38 years 07 months and retired as Honorary Flying Officer but pension in OROP has been fixed along with 32 years length of service.

15. Many Jawans are not getting their Last Rank's pension in spite of 6CPC recommendation and even after the Judgment from Hon. Supreme Court on Pay and Pension from 01.01.2006. How can it be OROP once the government is paying the Lower Rank's pension which is quite less than the entitled normal pension without OROP?

16.  Equal MSP and equal Disability pension for all combat soldiers to be given. All JCO/OR to be given same pension as per x group pay and Pension must be fixed on Last pay of present rank as before 6th CPC.

17. Reinstate 70 % pension for all who left before superannuation.

OROP: Steps being taken to rectify anomalies

Kochi: Seeking to reach out to retired soldiers, Union government today assured the ex-servicemen that it was taking all steps for "resolving the anomalies" in One Rank One Pension (OROP) and seventh pay commission.

Minister of State for Defence, Subhash Bhamre, also said Prime Minister Narendra Modi and Defence Minister Manohar Parrikar, who are "very sensitive" to the issues of ex-servicemen, are "personally looking into the effective implementation" of OROP scheme.

"The issue of OROP is the area of concern for the ex-servicemen. Number of representations were being received from ex-servicemen about OROP," he said, inaugurating the Kerala State conference of the 'Akhil Bharathiya Poorva Sainik Seva Parishad' here.

He said approximately one lakh defence pensioners/family pensioners were yet to get the benefits of OROP because of missing information such as non-update of records or unavailability of date of birth of family pensioners.

"Government is taking expeditious steps to get the payment released to left out pensioners on priority basis," he said.

The Minister also dismissed media reports about down-gradation of military ranks vis-a-vis civilian cadre.

"Was there any down gradation? The answer is No," he said.

Bhamre said a letter was issued by the Defence Ministry on October 18 regarding the equivalence of officers of a civilian cadre which is known as the Armed Forces Headquarters Civil Service (AFHQ CS).

"The letter reiterated the existing equivalence of joint director, director and principal director of AFHQ with Colonel, Brigadier and Major General equivalents respectively based on duties and functional responsibilities.

"This equivalences is not new and it has been clarified on several occasions in 1991, 1992, 2000, 2004 and 2005.Therefore, this alleged down gradation was a complete misinterpretation of facts," the Minister said.

The service ranks and designations and the channel of reporting continued as earlier, he said alleging that an attempt was being made by some quarters to project a negative image of the government.

"The government is most sensitive and receptive to the needs of the armed forces," the Minister said.

"ओआरओपी'साठी सरकार प्रयत्नशील - - पीटीआय

कोची - ‘वन रॅंक वन पेन्शन‘ (ओआरओपी) आणि सातव्या वेतन आयोगाबाबत असलेले सर्व वाद सोडविण्यासाठी पूर्ण प्रयत्न करत असल्याचे केंद्र सरकारने आज माजी सैनिकांना सांगितले. सैनिकांच्या बाबतीत अत्यंत संवेदनशील असलेले पंतप्रधान नरेंद्र मोदी आणि संरक्षणमंत्री मनोहर पर्रीकर या दोघांचे या प्रकरणात लक्ष असल्याचे संरक्षण राज्यमंत्री सुभाष भामरे यांनी माजी सैनिकांना सांगितले.

"अखिल भारतीय माजी सैनिक सेवा परिषदे‘च्या केरळ राज्याच्या परिषदेचे उद्‌घाटन आज भामरे यांच्या हस्ते झाले. या वेळी त्यांनी माजी सैनिकांना "ओआरओपी‘च्या अंमलबजावणीबाबत आश्‍वस्त केले. सविस्तर माहिती नसल्याने अद्यापही एक लाख माजी सैनिकांना अथवा त्यांच्या कुटुंबीयांना "ओआरओपी‘चा लाभ मिळाला नसल्याचे भामरे म्हणाले. ही सर्व माहिती गोळा करून लवकरात लवकर त्यांना या योजनेचा लाभ मिळवून देण्यासाठी सरकार प्रयत्नशील असल्याचे त्यांनी सांगितले.

Will restart ‘andolan’ if OROP is not implemented: Anna Hazare

Ahmednagar (Maharashtra): Social Activist Anna Hazare on Wednesday said that the Centre's betrayal to the nations' ex-servicemen over the implementation of the One Rank One Pension scheme resulted in the suicide of Ram Kishan Grewal, and threatened to restart his agitation on the implementation of the scheme.

"No harm in fighting for your own right and we are not begging in front of anybody," Anna Hazare said on launching a protest again.

"Earlier the government had promised that the OROP will be implemented and we trusted them, which is why we stopped our protest," Anna said.

Stating that it was unfortunate that an ex-serviceman committed suicide over the failure of the scheme's implementation, the activist stated that on one hand the government glorifies soldiers and on the other hand doesn't fulfill promises.

Speaking to ANI here, Anna further said that armed forces put themselves on the line of fire in testing conditions to protect the country, yet their very right has been denied to them.

Earlier today, ex-serviceman Ram Kishan Grewal allegedly committed suicide by consuming poison at Delhi's Jantar Mantar area, over the issue of One Rank One Pension scheme (OROP)

In his suicide note, he said that he is taking such an extreme step for the sake of the soldiers.

The Police said that he along with some other ex-servicemen were in the process of submitting a memorandum to the Defence Ministry over the issue of OROP.

Grewal was a resident of Bumla village in Bhiwani, Haryana.

Ex-servicemen have been protesting over the OROP scheme introduced by the government.

Earlier, Congress Vice President Rahul Gandhi, who was detained today after he tried to meet the kin of ex-serviceman Ram Kishan Grewal, lashed out at the Delhi Police for arresting the former jawan's family besides himself.

Rahul Gandhi was stopped close to the gates of the Ram Manohar Lohia Hospital here when he went to meet the family of the victim Grewal.

Delhi deputy chief minister Manish Sisodia was also 'forcibly removed' from the hospital premises after he went to meet the grieving family. He later tweeted, "I had gone to the hospital to meet the family of the ex-serviceman, not to launch a dharna. What mistake have I done?"

The police also detained Jaswant Grewal, the son of Subedar Grewal, after he joined AAP workers in impromptu protests outside the hospital. Gandhi called Jaswant's detention a "shame."

The Trinamool Congress also joined the beeline stating that its representative is on his way to the national capital to chime in the developments.

Subedar Grewal's family wants the government to fulfill the demands that he made in a petition that he planned to hand over to Defence Minister Manohar Parrikar later on Tuesday.

“Bank miscalculation” responsible for delay in OROP for deceased veteran: Sources

New Delhi: The delay in ex-serviceman Ram Kishan Grewal receiving the revised pension as per the One Rank One Pension (OROP) was due to problems in calculation at his bank's end and his case could have been resolved amicably if he had directly approached the government, sources said.

Ram Kishan Grewal was entitled to OROP and all the clearances had been made from the Centre's side but problems at the banks caused the delay.

Sources firmly state that the circumstances surrounding the suicide of Grewal, who took his life by consuming poison, called for thorough investigation, as a probe is also needed to figure out who was with him when he took the extreme step and also who provided the poison.

It also needs to be ascertained if anybody may have taken advantage of his "troubled mind to provoke him to take the extreme step".

Grewal was entitled to OROP and all the clearances had been made from the Centre's side but problems at the banks caused the delay.

Defence Minister Manohar Parrikar has sought details of the incident from the department of ex-servicemen welfare.

"Saddened by the death of subedar Ram Kishen Grewal. I express my heartfelt condolences. I have asked officials to provide me with details," Parrikar tweeted.

Earlier today, Parrikar emphasised that the government was committed to the welfare of ex-servicemen and said a total of Rs 5,507.47 crore has been disbursed under the scheme.

Giving details of the OROP implementation, Parrikar said there were 20,63,763 beneficiaries before July 2014 and that 19,12,520 pensioners have been paid the first instalment and 1,50,313 cases are pending verification and authentication of beneficiaries.

Meanwhile, a massive political storm has broken out over Grewal's death as parties are joining forces to come down heavily on the Centre over the delay in the implementation of OROP.

Ex-serviceman commits suicide in Delhi over OROP

New Delhi: Ex-serviceman Ram Kishan Grewal allegedly committed suicide at the Jantar Mantar in Delhi over the delay in implementation of the One Rank One Pension (OROP) scheme.

However, the cause behind Grewal's suicide is yet to be ascertained.

Delhi Chief Minister Arvind Kejriwal will be visiting Grewal's family in Haryana's Bhiwani later in the day.

Dubbing the incident as 'unfortunate', Aam Aadmi Party (AAP) MLA Commando Surinder Singh alleged that the BJP-led NDA Government at the Centre was indulging in politics over the Indian Army.

"A very unfortunate incident has taken place with this family. For the last one day, Grewal and 50 other ex-servicemen were sitting on strike. They wanted to present their memorandum to the Defence Minister. He had to wait for two days for the Defence Minister. When he was going to meet him, he faced many hurdles. In his memorandum he wrote that he is sacrificing his life for the nation and for the soldiers," he told the media.

Singh further said the salary that the soldiers get is not enough for living.

"On one hand, the government is doing politics over the Indian Army and on the other hand, the soldiers are forced to commit suicide today. The salary that a soldier gets is not enough for living. I condemn this incident," said Singh.

The AAP leader also used the occasion to target Defence Minister Manohar Parrikar and accused the latter of indulging in petty political gains over the sacrifice of soldiers.

"I want to tell the Defence Minister to wake up...you are the Defence Minister of the nation...you do politics in the name of the soldiers. You try to take votes in the name of the soldiers. You don't even meet the soldiers. The soldiers have to commit suicide to even present a memorandum," said Singh.

"Today, the entire nation and all the ex-servicemen are standing with the family. His sacrifice won't go in vain. We will meet with the Defence Minister with this demand," he added.

Grewal's son Jaswant urged the Modi Government to look into the matter.

"My father sacrificed for the nation. He was demanding the One Rank, One Pension. The Modi Government should think about this," he said.

Rs 5,500 cr paid as first OROP instalment: PM

Kinnaur: The first installment of nearly Rs 5,500 crore has been paid for implementing the OROP scheme, Prime Minister Narendra Modi today said while asserting that he has "fulfilled the promise" he made to ex-servicemen on the issue that has been hanging fire for the last 40 years.

"The OROP money will reach ex-servicemen in four installments. Nearly, Rs 5,500 crore has been paid as the first installment," PM Modi said.

The Prime Minister, while celebrating Diwali with army and ITBP personnel in Sumdo here, over 270 km from state capital Shimla, also lauded the role of the security force personnel guarding and protecting the country.

"Spent time with our courageous @ITBP_official & Army Jawans at Sumdo, Kinnaur district, Himachal Pradesh. Jai Jawan! Jai Hind!," he tweeted.

Earlier in his 'Mann ki Baat' programme on All India Radio, he saluted the valour of the armed forces and lauded their sacrifice while dedicating the festival of Diwali to them.

"The OROP was not about just Rs 200 or Rs 500 crore, but Rs 10,000 crore... After I became the PM, and decided that I had to do (implement) it, the entire government lost sleep over it... It was not possible for the government to pay in one go, so I requested the ex-servicemen to accept it in four instalments.

"The money will reach them in four installments. Nearly, Rs 5,500 crore has been paid as the first installment," Modi said.

He said the issue had been pending for "40 years" as certain people in the previous governments "did not know" about OROP (scheme), and therefore "only Rs 500 crore was allocated" for the purpose.

Modi also said that many people thought that if the scheme was not implemented, a section of "ex-servicemen would turn against the government".

The Prime Minister, on his way to Sumdo, met civilians at Himachal's Chango village, close to the Sino-Indian border.

"Made unscheduled stop at Chango village, close to Somdu, to wish people on Diwali. Was deeply touched by the impromptu reception & their joy," Modi tweeted.

"The Prime Minister spent time with ITBP jawans and personnel of Dogra Scouts of army at Sumdo on border of Kinnaur and Spiti, and distributed sweets to them," an official said.

Panel on OROP not hearing individuals: ex-serviceman tells HC

New Delhi: Delhi High Court was today told that the one-member judicial commission, set up to deal with grievances of ex-servicemen on One Rank One Pension (OROP), was not hearing issues raised by an individual but dealing only with contentions raised by organisations.

The Centre refuted the claims before a bench of justices B D Ahmed and Ashutosh Kumar saying the commission was hearing the grievances raised before it not only by organisations but by individuals also.

The bench was hearing a plea seeking directions to Ministry of Defence and the commission, headed by Justice (Retd) L Narasimha Reddy, "to give an effective public hearing to those affected or aggrieved by implementation of OROP".

When the matter came up for hearing, petitioner S P Singh told the bench he had approached the commission with his grievances but was not heard and told that the panel was only hearing the contentions of organisations.

The petitioner also claimed that armed forces officers were sitting with the panel despite the fact that it was a one-member judicial commission.

Central government standing counsel Anurag Ahluwalia refuted the claims of the petitioner saying the commission was also hearing the grievances of individuals and the officers were present to assist the panel.

He also said the petitioner was heard by the panel.

The bench then asked the petitioner to file an affidavit stating that he was not given an opportunity by the commission to put forth his grievances and posted the matter for further hearing on September 28.

The Centre had earlier told the court it has extended by six months the term of the one-member panel on OROP.

The petitioner, who is an ex-serviceman, has said that as per a Ministry letter dated April 13, "Defence Forces pensioners/family pensioners, Defence Pensioners' Associations can submit their suggestions/views on the revised pension as notified, to the MoD, through post or by email within 15 days i.E. By April 29, 2016".

The petitioner had contended that this information was not published in the newspapers and, therefore, people were not informed about it. He had said that the time given to forward the representations was "very short".

The Centre had told the court that date for forwarding suggestions and representations was later extended to May 15.

OROP panel hearing ex-servicemen issues: Government tells High Court

New Delhi: The Centre today told the Delhi High Court that it has extended by six months the term of the one-member judicial commission on OROP which has commenced public hearings on grievances of ex-servicemen from yesterday.

The submission was made by the government before a bench of justices Badar Durrez Ahmed and Ashutosh Kumar which was hearing a PIL for public hearing of ex-servicemen's grievances as well as extension of the term of the commission, headed by Justice (retired) L Narasimha Reddy.

Central government standing counsel Anurag Ahluwalia told the court that the first public hearing was held at Chandigarh yesterday and would be held at various other places across the country, ending on September 21.

He said the hearing in Delhi would be held on August 19, after which the petitioner's lawyer, Satya Ranjan Swain, said details of the time and venue of the hearing have not been disclosed.

Pursuant to the submission by the petitioner's lawyer, the court directed the government to provide the time and venue details of the public hearing in Delhi to the petitioner today itself and listed the matter for hearing on August 24.

After the hearing and order by the court, Swain said he received an email from the government stating that the public hearing in Delhi would be held on August 19 at 11 AM at Vasundhra Vatika, Raj Rif Centre, Delhi Cantonment here.

The petitioner, S P Singh, who is an ex-serviceman, has sought directions to the Ministry of Defence and the commission "to give an effective public hearing to those affected or aggrieved by implementation of One Rank One Pension (OROP)".

According to the petition, as per a Ministry letter dated April 13, "Defence Forces pensioners/family pensioners, Defence Pensioners' Associations can submit their suggestions/ views on the revised pension as notified, to the MoD, through post or by email within 15 days i.e. by April 29, 2016".

OROP–Kaya Paya Kya Khoya – Cdr Ravindra Pathak

The views expressed here are entirely my own and not as a member of any organization.

It has been a long struggle for OROP for the veterans, spread over period of almost 42 yrs. Whilst the demand was languishing in the files of Babudom it is only in 2008 when the Indian Ex Servicemen Movement took up the issue did it resurface and how much it impacted all those involved and associated with it is well known.

Having been associated with the movement for a while I often thought: what have we achieved and what have we lost. I am penning my thoughts at random as they come to mind.

The struggle had many who were affected by it namely the Indian Ex Servicemen Movement (IESM), the Government of India, the two political parties, etc I will cover in a free flow of thoughts.

The IESM over the years was in the acknowledged leadership role for the fight and it was able to achieve at least partly what it had set out to get. Regrettably, ever since the issue of notification by the GOI it has become somewhat of a pariah with no one willing to talk to it due its policy of continued agitation mode.

So what have been the achievements of IESM?

Creation of awareness among the veterans of their rights leading to setting up of grievance mechanisms by Army and Air force while the Navy has just started with tentative steps

A new-found life in the various ESM orgs

Awareness among politicians that united veterans would now be a force to reckon if they are allowed to unite.

The last two parts of IESM achievements have actually to my mind worked against it as first the ESM NGO became very aggressive and started to try and usurp the funds which the movement has managed to collect as voluntary donations and the political parties made is a ESM point to ensure that they do not unite. For this both the ESM org and politicians have tried all tricks known to them.

The IESM has also erred.

The response of IESM to the 5 th September 2015 notification was ill thought out. Acknowledgement was needed then, probably with caveat and keeping room open for further negotiations. But IESM failed there miserably.

Was there a failure on the part of IESM in targeting the bureaucracy? Well that is debatable but surely the empire struck back with the notification, which certainly was not to the RM’s liking and yet read out by him. It’s often said we are our worst enemy. To an extent this has happened in recent times. And who took advantage? The Bureaucrat.  Ironically, without working too hard. IESM MADE their own enemies.

IESM, probably in their enthusiasm of the support they got, forgot to look at the tight rope Modi has to walk to get his targets met. He inherited a lethargic bureaucracy unwilling to change and no hold barred highly stung miniscule but effectively disruptive Congress. He has a handful cleaning the muck of last 67 years with very limited talent and true followers of his within the party and the cabinet and it would only have been wise to have acknowledged his positive role in the OROP saga.

In army, and even in Naval manoeuvres, we rely on 'one foot on ground’, a 'pivot' round which we manoeuvre. IESM needed to have retained that 'pivot' - RM to my mind was one? They dislodged him thoughtlessly.

Next is the Veteran himself.

Largely ignorant veterans are happy that something has come through but are not aware of what they should have got. The veteran has been largely charged up with emotions for the failure of the GOI to give true OROP even though one must admit that against odds and substantial opposition from within the cabinet and the bureaucracy the Modi-Parikkar combine has been able to at least accept the need for OROP and have partly delivered.

Modi and the RM are reportedly unhappy with the fact that largely they have not got credit for the OROP that they claim to have given. Even if one accepts getting OROP, even though partly, due to them the fact remains that the undue delay in its implementation, the kind of statements made at various stages by various ministers and the prime minister himself, has led to anger and though some politically correct ESM Orgs have thanked them, at least in one such thanksgiving routine, they were asked if they were really happy. It is learnt that whilst making a presentation to Reddy Committee some ESM organizations started with we are Happy to---. Justice Reddy is reported to have leaned forward, lowered his spectacles and exclaimed- Really?

The BJP has been looked upon as someone who came to power on the large support from ESM, rightly or wrongly. The way the ESM were treated after the elections, forced to sit for Hunger strike, fast unto death, sit on relay hunger strike and hold protest rallies across the country and of course the police action has only added fuel to fire and has forced some of the veterans to look at election interference as a new tool to get their dues.

The Congress knew full well that they would not return to power after the last elections and as one-upmanship, declared OROP knowing well that they would not have to carry the burden of implementing it. Mere tokenism was resorted to in normal Congress style. They did manage to put Modi in a corner but lost all sympathy of veterans except their diehard loyalist much like their political loyalists.

The CGDA organization has been the greatest loser in the entire story, what with their poor drafting of circulars, perceived to be playing a negative role in making the tables and then the errors in the tables where they had to issue clarifications within a month or so, speaks poorly of their ability to deliver. This has been so since the 6 CPC implementation but has been aggravated by issue of poorly drafted circulars during the OROP struggle. This is gone to such an extent now that people are demanding that CGDA is restricted to their basic task of Audit and accounts rather than meddling with policy matters.

The DESW has always been seen not as a welfare agency for the veterans but more as being anti veterans. They have not endeared themselves to veterans any better during the OROP struggle where they even allowed a lower formation working as auditor to check tables and calculations made and approved by the RM. Their penchant for filing appeals in courts has been well known. It is learnt that even after the current RM took control of the Department, things have only marginally improved. Look at the delay in issuing the circular for doing away with 33 yrs rule. No wonder there is a clamour for reorganization of the department with a mix of some veterans and serving being inducted. One only hopes that it does not become a pure defence manned organization.

How have the serving been affected? This is the most dangerous part of the story of the OROP saga.

With the social media and its easy access, more awareness amongst the serving of their rights and realization that they have been let down not only by the Bureaucrat–politico combine but also by their own has had very adverse effect within the services. Through court cases, they have realized that they have been short changed for a long time. The clear indicator of this is the number of cases in AFT and the ultimate being the NFU case by a serving officer. To a large extent it is the failure of Modi and his team of RM+FM (combined) first, then FM and RM that allowed the whole issue to be delayed as usual, thereby causing unwanted heartburn and a feeling of being let down not only of the veterans but also the future veterans. If stories are to be believed, large number of dissatisfied serving are there now in the forces. This is where the security of the country has taken its biggest hit.

The serving senior officers have taken a major hit in all this by not taking a firm stand and with the new found awareness among the veterans and serving and the spread of social media they will have to unlearn old dictates of human behaviour and management and do a complete rethink on the way to handle a more enthused, knowledgeable and active veterans and the serving as well. If things don’t change it will be to the peril of the security of the country.

Let us hope the GOI learns its lesson and also teaches it to the bureaucracy to change their attitude. The Experts committee appointed by the RM has minced no words in regard to the need to change in attitudes all-round.

To summarize I feel ESM may have gained financially from OROP, but in the process there have been large changes in the environment in terms of awareness among Veterans and serving ,hopefully a realization that the HR functions have to undergo change in the armed forces from the past and the finality that ESM will remain disunited and the Bureaucrat-politico combine will continue to exploit us. However the biggest looser is  the national security has  been the victim and it would take years to mend ways.

It is not a all lost situation and I feel confident that the present PM –RM combo will be able to re-establish the status of armed forces in the country.

ESM sitrep 11 Jun 2016 evening

Dear Colleagues,

Over the last few weeks, there had been a flood of queries from veterans, mainly expressing apprehension that with OROP granted, we may be denied the benefit of the 7th Pay Commission. To get authentic clarification I met the Finance Minister Shri Arun Jaitley Jun 11.

Summary of the points discussed ensues.
Koshyari Committee Report

At the outset I emphasised that irrespective of whether the government has formally accepted the Koshyari Committee report or not (it has been earlier stated that the report is a mere recommendation from one of the several committees and has not been officially accepted), in the perception of the veterans, the correct OROP definition is what the Koshyari Committee has stated. Seen in that light any shortfall will keep rankling. Pay Commission vis-à-vis OROP On my expressing the widely rumoured apprehension that since we have just received OROP, we may be denied the Pay Commission benefits, the Minister clarified that there is no basis for such an apprehension. The veterans WILL get the due benefit of the 7th Pay Commission and the grant of OROP will not affect it in any way.

OROP Anomalies I underscored the two major anomalies ie, re-fixation of pension on the maximum instead of the average of maximum and minimum, and revision every year instead of five yearly as given in the Notification. I further stressed that the expenditure involved in both may be just around Rs 3,500 Crore, which is not significantly large considering what has already been sanctioned. The government should agree to remove these two anomalies. He listened patiently but made no comment except saying "let us see".

One-Man Judicial Committee

Although it was not said in clear terms, the Minister's body language was suggestive of the One-Man judicial Committee being given additional time to complete its task. More importantly, I asked what would be the government response in case the Committee makes recommendations that are pro-veterans vis-à-vis the OROP anomalies, as we had presented to the Committee. The Finance Minister was positive on the subject. He stated that as it is the government has given nearly 90% of the OROP as we pensioners interpret it. Whatever recommendations the Committee makes would form a very small percentage of the defence budget and the government would not be averse to accepting it.

Government Announces One Rank One Pension Scheme for Ex-Servicemen

The Government has announced the One Rank One Pension scheme for the Ex-Servicemen. This was announced by the Defence Minister Shri Manohar Parrikar here today. The following is the statement of the Defence Minister:

“Government of India respects its Defence Forces and Ex-Servicemen for their valour, patriotism and sacrifices. The Government is proud of their devotion to duty and bravery. Our forces, besides vigilantly and gallantly defending the nation, have displayed exemplary standards of courage and bravery in natural calamities, law and order situations and other difficult circumstances.

The issue of “One Rank One Pension” (OROP) has been pending for nearly four decades. It is a matter of deep anguish that the various governments remained ambivalent on the issue of OROP. In February 2014, the then Government stated that OROP would be implemented in 2014-15, but did not specify what OROP would be, how it would be implemented or how much it would cost. An estimated Rs. 500 crore provided for OROP in the budget presented in February 2014 by the then government was not based on any thorough analysis. It is pertinent to mention that the then Minister of State for Defence in 2009 had, in reply to a question, informed Parliament that there are administrative, technical and financial difficulties in implementing OROP. It is for these reasons that the present government took some time to fulfil its promise.

Prime Minister Shri Narendra Modi has, on various occasions, reiterated the Government’s commitment to implement OROP for Ex-Servicemen under military pension. As stated above, the previous government has estimated that OROP would be implemented with a budget provision of a mere Rs. 500 crore. The reality, however, is that to implement OROP, the estimated cost to the exchequer would be Rs. 8,000 to 10,000 crore at present, and will increase further in future.

The Government held extensive consultations with experts and Ex-Servicemen. The main argument for OROP is that the Defence personnel retire early and thus are not able to get the benefits of serving till normal retirement age. Despite the huge fiscal burden, given its commitment to the welfare of Ex-Servicemen, the Government has taken a decision to implement the OROP.

In simple terms, OROP implies that uniform pension be paid to the Armed Forces personnel retiring in the same rank with the same length of service, regardless of their date of retirement. Future enhancements in the rates of pension would be automatically passed on to the past pensioners. This implies bridging the gap between the rate of pension of current and past pensioners at periodic intervals.

Under this definition, it has been decided that the gap between rate of pension of current pensioners and past pensioners will be bridged every 5 years.

Under the OROP Scheme:

The benefit will be given with effect from 1st July, 2014. The present government assumed office on 26th May, 2014 and therefore, it has been decided to make the scheme effective from a date immediately after.

Arrears will be paid in four half-yearly instalments. All widows, including war widows, will be paid arrears in one instalment.

To begin with, OROP would be fixed on the basis of calendar year 2013.

Pension will be re-fixed for all pensioners retiring in the same rank and with the same length of service as the average of minimum and maximum pension in 2013. Those drawing pensions above the average will be protected.

Personnel who voluntarily retire will not be covered under the OROP scheme.

In future, the pension would be re-fixed every 5 years.

It is estimated that the expenditure on arrears alone would be ten to twelve thousand crores of rupees.  Apart from the fact that the previous government had provided for only Rs. 500 crore in the budget, it is noteworthy that the Koshiyari Committee had accepted the estimate of Rs. 235 crore as additional financial burden to implement OROP. The present government has accepted OROP in true spirit without being constrained by these inaccurate estimates.

OROP is a complex issue. A thorough examination of interests of retirees of different periods and different ranks is needed. The inter-service issues of the three Forces also require consideration. This is not an administrative matter alone. Therefore, it has also been decided that a One Member Judicial Committee would be constituted which will give its report in six months.

Prime Minister Shri Modi has fulfilled his commitment and approved OROP for Armed Forces personnel. Ministry of Defence will soon issue detailed Government Order.”

Update from Jantar Mantar

RHS has been suspended at JM since 29 April. This has been done against the will of majority of ESM but to create a congenial atmosphere for talks and for the Government to fulfil its promises given to Ex-servicemen community. IESM believes in talks and is ever ready for talks. We hope that Government will use this opportunity to find solution to the anomalies pointed out by IESM/UFESM(JM) and many other ESM organization in India. All ESM organisations in India have given same anomalies for implemented OROP to MOD. This in-fact is an indication of convergence of thought process of ESM organisations of India and indication of unity of purpose. This is good news. 24 lac ESM have joined hands for a purpose and the purpose is revocation of soldier's status as it was existing pre 1973. Less than that is not acceptable to Armed Forces of India.

IESM/UFESM(JM) continues to stay at JM as our tents are in place and JM is being treated by dedicated soldiers as temple, Gurudwara and is place of worship for us. This is bold signature of ESM pride and communicates that ESM will oppose tooth and nail stepchild treatment to ESM by the Govt.
ESM reserve their right to resume agitation at JM if anomalies pointed out are not solved to their satisfaction by the Justice Reddy committee. J Reddy is likely to give its recommendations on 14 June 2016. ESM is hoping that MOD does not play any tricks and does not extend the tenure of J Reddy committee and the recommendations are given on time. IESM/UFESM( JM ) is also hopeful that our concerns will be suitably addressed by J Reddy.

Court Case For OROP

Dr Ram Jethmalani visited JM on 29 April and assured all ESM of India that OROP is now his battle and he will fight it legally and get full OROP for ESM. He requested that RHS at JM be suspended for some time to create a congenial atmosphere for talks and resolution of the issue. Draft writ petition for OROP for filing in HSC is ready and is being vetted by Dr Ram Jethmalani. We are working towards filing it before summer recess of courts. However if due to pressure of large number of cases in SC, it is not filed now then it will be files asap the courts open after summer recess.

Case for Broadbanding of Disability pension

As earlier explained that honourable courts have ruled that broad-banding of disability is the right of soldier and it must be given to them. However due to some existing rules it is given to only those soldiers who file a case on Govt. IESM has already prepared a case for filing for giving broad-banding advantage to soldiers. For this purpose IESM had invited Vakalatnama from the affected soldiers. We have received vakalatnamas and are ready to file the case in AFT Delhi. As per court procedures expenditure on each litigant soldier comes out to be around Rs 600/. Add lawyers fee on it and it turns out to be a large expenditure. IESM has decided to extend this service for all soldiers free of cost. It is for information of all that IESM is not charging any fee for filing the case. Please do not give any money to anyone for filing your disability broad-banding to any organisation or any convener of IESM. IESM will bear all the expenditure on this case. IESM has closed the list for the first case. IESM will be circulating the list of names of soldiers whose vakalatnamas are complete and have been included in the first list.

There is no need to get disheartened if your name does not appear in the list. This could be because your details are not complete. IESM will be filing another case soon for broad-banding of disability pension.

Case for Nb Subedar to Hony Nb Subedars

This case is almost ready for filing. IESM is ready with the list and the case and hopes to file it before summer recess. List of the names of ESM will be circulated within one week. There is no need to panic if you do not find your name in the first list. It only means that your vakalatnama is not complete. We will include your name in the second case which will be filed soon.

It is repeated that IESM will not be charging any fee for your name to be included in the case. Please do not pay any fee to anyone for your name to be included in the list.

If you do not find your name in the list ( to be circulated within a week ), please do not worry as we will again ask for names and will include your name in the next list.

Case for arrears from Jan 2006

This case is also under preparation and will be filed soon, may be after summer recess of the courts. Please send your vakalatnamas for your name to be included in this.

Court cases filed against office bearers of IESM

It is very unfortunate that ESM are fighting within for their egos. This fight is more prominent in IESM wherein 13 members of GB are on one side and only six members of GB are on other side. The life of that GB has expired on 2 Dec 14. Fresh elections for electing new GB have been held on 27 Oct 14, New GB has been elected and is pending approval from High Court. Despite all this an ex colleague has filed a complaint. This complaint has been investigated by police twice once in Dec 2013 and second time in May 2014. Both times police did not find any prima facie evidence in it and consigned to record room. But what can you do if one of the ESM is hell bent in spoiling the image of ESM and prove to Govt/Bureaucrats that ESM are not united and Govt can take advantage of this fragmentation among ESM. He kept on repeating and putting pressure for filing a FIR. On his intense pressure Govt finally buckled and an FIR has been filed for charges which had been rejected by police at ACP level twice.
IESM office bearers are busy replying to these false charges and are in discussion with lawyers, and hence their attention to OROP anomalies and JM has been diluted. This ex colleague's plan is only to divert IESM leaders’ attention from the real issue of OROP so that he can hog the lime light. But friends IESM assures ESM of India that their welfare is dear to us than our own safety and we will not permit anomalies in OROP to be deferred to another pay commission.
For your information the false charges of withdrawal of funds, which our colleague has preferred on us are for the period in which he himself was the Chairman and the funds were withdrawn for attending the rallies in his constituency, from where he later contested elections without even resigning from Chairmanship of IESM. So much for his moral values for declaring IESM apolitical.
In fact if you all will notice that the fight started because he wanted to use IESM platform for his own election which was not permitted by Gov Body. This was the main reason of falling apart of a united Gov Body of IESM and thereby sowing seeds of disunity. He has done this on whose bidding is for the community to decide.

ESM Vote Power

30 lac ESM and about 15 lac serving soldiers (with around 5 to 6 crores votes)  have been denied their place in India only because soldier thought that his job is fighting for the country and protecting the borders. We never asked for our rights and money. Bureaucrats took advantage of this negligence and have deprived the soldier for his rightful place in India and for his financial status. Friends we have now realized that we will have to fight for our rights and take our rightful dues. IESM/UFESM(JM) has realized that we have to be united to get our prestige and position back. These politicians and bureaucrats will not give us our dues and even snatch our dues if we do not unite and show our voting power. An attempt is being made in Punjab to unite all ESM under banner of UFESM(JM)  and show to political parties that ESM vote bank is around 60 lacs and we have now woken up and know our strength.
Friends we can get our rightful place in India only and only if we put our soldiers in state assemblies and parliament. We will not beg for our Izzat and our rights but will write it ourselves. This will be possible only if we are united and vote as a block for welfare of foujis with a singular aim of sending them in assemblies and Parliament.
IESM/UFESM(JM) has decided to integrate ESM and kissan of India and has given a slogan from PANCHAYAT TO PARLIAMENT.
An attempt will be made in Punjab election to unite all ESM under banner of UFESM(JM) and show our strength. If this experiment delivers fruits it will be attempted on all India level. IESM requests all ESM to unite and become a power.
TIME HAS COME TO DISCARD GREEDY POLITICAL SYSTEM AND PUT SOME MEN WITH INTEGRITY IN STATE ASSEMBLIES AND PARLIAMENT.
COME JOIN HANDS AND HELP US TO DEVELOP INDIA AND TAKE IT TO PATH OF PROSPERITY.
WE ALL KNOW THERE IS NO DEARTH OF FUNDS IN INDIA. WE ARE NOT GROWING BECAUSE OF CORRUPTION AND BECAUSE OF BAD POLITICS.

6CPC and OROP Arrears - Brig CS Vidyasagar

Dear Smt Damayanthi Garu,

1.         I am sure you must be fed up with my mails. One more request is, Madam, I am getting too many complaints from members and non – members of our organisation Tri Services Ex-Servicemen Welfare Association (TSEWA) that they have not received their 6th CPC arrears necessitated by Circular 547 for JCOs & OR, by Circular 548 for Officers and also OROP arrears. The reason for non – remittance of such arrears is banks do not have qualifying service or group (for JCOs & OR). Unless banks have this information, arrears cannot be worked out as their software will not generate arrears sheet.

2.         This fact that some of the Ex-Servicemen and most of the family pensioners may not have the data i.e. qualifying service or Group (X or Y). This is known to PCDA (Pensions) Allahabad only. They advised banks to send details of such pensioners. My meeting with heads of CPPC, SBI, SBH and Andhra Bank in Hyderabad tells me that banks have duly notified personnel whose qualifying service and Group are not available with them and sought the same from PCDA (P) Allahabad. More than two months have passed yet PCDA (P) Allahabad has not furnished the information to the banks.

3          Banks are getting bad name for no reason whatsoever. Madam, one cursory look at any PPO of old pensioners who retired in early 1980s or late 1970s tell us that other than rank, name, pension, DCRG sanctioned, PDA, nothing more is mentioned in PPO of those days. Even wife’s name is not there. Could not PCDA (P) Allahabad digitise all original PPOs to know whose qualifying service and Group are not there in the PPO? Then list of such pensioners could have been easily made and the missing data could have been obtained either from PCDA (O) Pune for Army officers or from Record Offices for JCOs/OR or from Army HQ, AGs Branch (MP 5/6) and DGAFMS office for Officers.

4.         May I therefore request your indulgence to give suitable instructions to all PSAs to immediately furnish details of qualifying service and group to all those pensioners whose data is not included in original PPOs and send a copy to concerned pensioners for their records. This will help CPPCs to work out arrears of 6th CPC & OROP and remit the same to the pensioners without any further delay.
