After these three organisations have joined hands to demand justice – the pressure on the Government will multiply many fold.

Now we all have to make sure that if any individual Indian Military Veteran tries to score brownies for his political ambitions – he must be strongly advised to behave himself.

In the letter sent to RM on 21 Jan, all the urgent demands for justice to Indian Military Veterans and Veer Naris have been included.

Once these urgent issues are sorted out – the other issues will be taken up with the Government.

Urgent Need to Rectify Anomalies in OROP in Govt notification dated 7 Nov 15

Dear Shri Manohar Parrikar ji

Please refer to Govt executive letter dated 26 Feb 14, press release dated 5 Sep 15, Govt notification dated 7 Nov 15 and 14 Dec 15. Please also refer to the statement made by MOS Defence Sh Rao Inderjit Singh in Parliament on 2 Dec in reply to question asked by Sh Rajeev Chandrashekhar regarding implementation of OROP. (All attached)

One Rank One Pension was approved by UPA Govt in budget dated 17 Feb 14 and then by NDA Govt in their budget dated 10 Jun 14. UPA Government issued an executive order dated 26 Feb 14 for the implementation of OROP dues to veterans at the earliest. This was never implemented by the MOD nor a demand note was ever raised. The approved definition of OROP by two Governments is given below.

One Rank One Pension (OROP) implies that uniform pension be paid to the Armed Forces Personnel retiring in the same rank with the same length of service irrespective of their date of retirement and any future enhancement in the rates of pension to be automatically passed on to the past pensioners. This implies bridging the gap between the rate of pension of the current pensioners and the past pensioners, and also future enhancements in the rate of pension to be automatically passed on to the past pensioners.

OROP implies that a senior rank soldier should never draw pension less than his junior rank soldier. This cardinal principle is the soul of OROP and must never be violated.

Government issued a notification on 7 Nov 15 for implementing OROP. Government reiterated above-mentioned definition of OROP in the letter but introduced some conditions in the notification that completely destroy the definition approved by two parliaments. These conditions have created four anomalies which completely violates the definition and thereby, the soul of OROP. These anomalies are discussed in detail in succeeding paragraphs.

1)    Fixation of Pension on calendar year of 2013 instead of FY of 2014: Fixation of pension as per calendar year 2013 would result in past retirees getting less pension of one increment than the soldier retiring today. This will result in past retirees drawing lesser pensions than present retirees. This will completely destroy definition of OROP approved by two Parliaments and will also result in loss of one increment across the board for past pensioners in perpetuity.

2)    Fixation of pension as mean of Min and Max pension: Fixing pension as mean of Min and Max pension of 2013 would result in more anomalies wherein same ranks with same length of service will draw two or more different pensions thus violating the very principle of OROP. This issue was discussed with RM in various meetings and after due deliberations it was decided that accepting highest pension of each rank in the year would meet the requirement as base of pension.

3)    Payment wef 1st Jul 14 instead of 1st Apr 14: OROP has been approved in budget of 2014-15 by two parliaments. As per norms of Government, all proposals approved in budget are applicable from 1st April of that FY. In the case of OROP, the Govt had issued specific orders to its applicability wef 1st April 14. Hence implementation date for OROP from 1st July will be against the Parliament approval. Changing the date would result in loss of 3 months emoluments for OROP across the board. However, if OROP implementation date is to be kept as 1st July, then the base pension should also be accepted as per the PPOs of July 2014.

4)    Pension Equalisation every five year: Pension equalisation every five year will result in a senior rank soldier drawing lesser pension than a junior rank soldier for five years thus OROP definition will be violated for five years. This will also result in permanent violation of definition as fresh cases will come up every year.

These anomalies will result in lesser pensions to widows, soldiers, NCOs and JCOs than what will be due to them on approval of OROP. This will result in veterans not getting OROP as per approved definition and will create large discontentment across all ranks.

There is a need to have a relook at the pensions of Hon Nb Subedars, Majors and Lt Cols.

a)     Some Havildars are granted rank of Hon Naib Subedar in view of their exemplary service. These soldiers are not granted pension of Naib Subedar thus making the Hon rank just ceremonial. It is requested that Hon Naib Subedars should get pension of a Naib Subedar rather than that of a Havildar. Similarly, this must be accepted as a principle and it should be applicable to all Hon ranks in case of NCOs and JCOs.

b)    There are only a few Majors as veterans. Moreover no officer is retiring in Major rank now. In the past, officers were promoted to Major rank after completing 13 yrs of service whereas present officers are getting promotion of Lt Col in 13 yrs. It will be justified to grant all pensioners of the rank of Major, minimum pension of Lt Col as they cannot be compared to present retirees as officers are not retiring as Majors any more. Number of such affected officers is not more than 800 and will not cause heavy burden to Govt.

c)     Similarly, all pre-2004 retiree Lt Cols should get the minimum pension of full Col. Presently all officers retire in the rank of Colonel hence all Lt Col equivalents should be granted min pension of Colonels

In view of above you are requested to rectify these anomalies and issue addendum to notification issued on 7 Nov 15 for implementation of OROP. We strongly believe that there will be no requirement of judicial committee for attending to anomalies creeping up in implementation of OROP. Grant of increase in pension in case of honorary ranks and Majors and Lt Col must also be approved as a good will gesture.

This letter is being signed by three major organizations with the approval of more than 200 organizations. List of such organizations is attached.

UFESM Press Release - Col Dinesh Nain

The United Front of Ex-Servicemen urges all agitating ex-service to unite in this hour of crisis and urges all the veterans to join hands to project a cohesive picture to the country and display a sense of maturity to the country.

The proposed Akrosh Rally by a group of fragmented elements of ex-servicemen who have been agitating for the cause without going into the broad-based merits of the One Rank One Pension cause is likely to do more harm to the cause than can be visulaised at this particular juncture.

The majority of the Ex-servicemen across the country feel that is better to wait and watch before the tables are out rather than to jump and make a wrong political move.

The dwindling support the OROP movement has been receiving from the press is also due to the unwarranted posturing by the agitating ex-servicemen.
The UFESM delegation met the Defence Minister (RM) on Nov 26 and Finance Minister on Nov 24 drawing positive response from both the Cabinet ministers.
The RM was categorical about the Central Government commitment to OROP in letter and spirit. The RM pointed out that whatever financial objections and bureaucratic hurdles the government was facing, it was more than willing to overcome in the right earnest. Regarding PMR, the RM said it was being address and so was the case of other objections.
The RM stated that he would discuss the major issues with the Prime Minister upon completing his international travel commitments.
The RM mentioned that after the Prime Minister had publicly accepted in principle the demand of OROP, the agitation by the few handful of ex servicemen only vitiate the atmosphere and spoil the bonhomie that was created after the announcement.
UFESM delegation is likely to meet the PM.

UFESM secretary general Lt Col DInesh Nain said, “We should take what we are getting and then wait. There is no point in making political rally when we are so close to the target. I urge all ex-servicemen not to hold the proposed rally and adopt and dignified wait and watch approach.”

Going by the announcements made by the RM, Finance Minister and Prime Minister Narendra Modi on implementing One Rank One Pension, the United Front of Ex-Servicemen is not taking part in the Akroash rally.
UFESM is a nation-wide umbrella organisation of 148 ex-servicemen organisations and NGOs. It is conducting itself in a dignified manner and not trying to score brownie points organisations.
UFESM stands for improving the economic conditions of the widows, jawans and JCOs. UFESM feels it is essential that military pension of jawans and JCOs be restored back to the pre-1973 status. Jawans should get 75 percent of the top scale while retiring as pension. JCOs should get 70 percent of top scale while retiring as pension and Officers case for NFUs for status to be taken up with the Supreme Court.

AN APPEAL FROM UNITED FRONT OF EX-SERVICEMEN
 
Hon’ble Prime Minister,
Jai Hind!
1.     Today is the 133nd Day of our Protest Movement “Relay Hunger Strike” at Jantar Mantar and other locations in the Country for Non Implementation of One Rank One Pension (OROP), the assurance given by you to the Defence Fraternity when you started your LS Election Campaign at Rewari on 15th Sep 2013.
2.     The announcement made by RM on 05th Sep 2015 regarding the Implementation of OROP is NO OROP and has seven serious shortcomings.  If implemented without the removal of these shortcomings, this will kill the very definition of OROP which has been approved by two Parliaments, strongly recommended by the Koshyari Committee and promised by you to ESM and Armed Forces Personnel. Sir you even promised the serving soldiers grant of OROP at the highest battle field in the world on Diwali day.
3.     OROP stands sanctioned by your Govt but not yet implemented.  By delaying it for the past 16 months after your Govt came to power, gives us no confidence and is a cause of serious concern to us for having been left out and not cared for. We are deeply hurt and anguished on this stepchild treatment by the Govt.
4.     It seems to us that bureaucracy is again at its best machination to delay, dilute and finally destroy our most legitimate, already sanctioned scheme of OROP. It is surprising that Govt has accepted the definition of OROP as approved by Koshiyari Committee but in the same breadth has imposed conditions thereby completely destroying the definition. This is the paradox disturbing the ESM and forcing them to sit at JM opposing this announcement.
5.     RM has been changing ‘goal post’ every now and then.  On 5th Sep 2015, he said the Notification will be issued in one month’s time.  Later, he said it will be issued before Navratri and now says, the notification will be issued after Bihar Elections.  It is a sanctioned scheme of the Government for the Defense personnel and issuing of Notification to our mind, is not barred by the Election Commission. This unnecessary dilly dallying on the announcement is adversely affecting morale of Armed Forces Personnel as they see their future at JM. It is giving them a feeling that they are being treated as stepchild in India and Government will probably not give justice to Armed Forces Personnel and Ex-servicemen.
6.     We do not at all like to be on the roads demanding OROP Implementation.  Sir, “JIS DESH KE SAINIK SARKON PAR US DESH KA DURBHAGYA HAI” We request our Prime Minister to issue instructions for the implementation of OROP exactly as per the approved definition without any Dilution at the earliest please.
7.     May we also request you for a meeting which we have sought many times earlier also but it seems our request might not have been brought to your knowledge?

1.  Govt has not yet implemented OROP which had been sanctioned by two parliaments, By UPA Govt on 17 Feb 2014 and by NDA Govt in its Budget in June 2014. President in his addresses to both houses of Parliament included implementation of OROP as priority action.
 
2. However, UPA Govt allotted only Rs 500 Crs and NDA only 1000 Crs whereas the amount required was Rs 8000 – 9000 Crs.
 
3. Today is 114th day of our Protest Movement at Jantar Mantar and at many other locations in the country.
 
4. On 5th Sep 2015, the Govt announced implementation of OROP but the statement made by RM has created more apprehensions in the mind of Defence Fraternity regarding the intention of the Govt to implement OROP as per the approved definition without any dilution.
 
5. In order to inform the people of the Country, we have initiated “Social media War” through all available mediums since the Govt seems to have gagged the Press both print and electronic since our Rally at Jantar Mantar New Delhi on 12 Sep 2015.
 
6. In addition, we have decided to conduct Rallies all over the Country.  Rallies have been held at Dehradun, Nagpur, Ambala, Agra, Gurdaspur, Khanna, NOIDA, Vadodra.  Largely attended and covered Press Conf has been held on 04 Oct 2015 at Patna.  Another Rally is being held at Hamirpur in HP on 08 Oct 2015.  A Sangrash Rally has been planned to be held at Jalandhar on 18 Oct 2015 from 10.30 hrs to 14.30 hrs.  During this Rally, we wish to showcase solidarity of the retired defence fraternity.
 
7.  All ESM are requested to attend Jalandhar Rally in large number and make it an historic Rally with Grand Success.
  
9.   Rallies have also been planned in Bombay, TN, MP, AP and KK.
 
10.  The above activities and more are being conducted across the Country to inform the people about the grave injustice being done to the Defence Fraternity.
 
11. Friends, spread the message of Punjab Rally across the Country to ensure that a very large number attends.
 
12.    Treat this letter as most urgent for action.

Dear Friends,
1.      The Govt has announced the implementation of OROP through the statement made by the RM on 05 Sep 2015.  While we appreciate   the decision of the Govt, there are a member of serious shortcomings in the statement of RM which will dilute the grant of OROP as per the approved definition. These shortcomings are givens below:-
 
·        Issue of VRS was wrongly brought in since in the military we have no rpt no VRS. We have Premature Retirement (PMR) where the defence personnel are allowed to retire after a given term of service to keep the Military young and other factors. OROP must be made applicable to all PMR retirees without any ifs and buts.

·        The approved definition requires that any change in the rate of pension is to be automatically passed to the past pensioner. Since, there is a change occurring every year due, to various factors, the equalization of pensions is required to be carried out once every year say  on 01 July. The Govt has stated that it would be done every five years which will defeat the very definition of OROP and will dilute the same. Many senior defence personnel will start drawing less pension than their juniors which is in contravention of the SC judgment.

·        During our discussions with the Govt, Base year 2013-2014 was accepted. This means that all past pensioners are to be brought up to 31 Mar 2014. The Govt has now stated calendar year 2013 and that too average pension of the calendar year. This will consequently deprive the pensioner of at least one increment.  The base year should be changed to 2014-2015 since the Govt has changed the goal post of granting OROP instead of 01 Apr 2014 as per earlier Govt orders to 01 July 2014. However, we are prepared to accept 31 Mar 2014 and not the average of the calendar year 2013.

·        Another important issue is regarding granting OROP pension taking into account the top of the scale. RM, during earlier discussion had accepted top of the scale for all past pensioners for the convenience of its implement-ability.  RM has now stated that it would be average of the scale.  This must be corrected to the top of the scale.
 
·        OROP is a concept in perpetuity and should be stated so in the Govt letter.    
 
·        Implementation of OROP is independent of 7th CPC or any future CPCs. The Govt approved CPC awards should integrate with OROP and CPC must not adjudicate or interfere with the grant of OROP.
 
2.    Friends, in order to showcase our solidarity a SAINIK EKTA Rally is being organized on 12 Sep 2015 at Jantar Mantar from 10 AM to 3 PM . All ESM of India must attend this Rally in large numbers to strengthen protest Movement and Relay Hunger Strike across the Country.

Ekata Rally at Jantar Mantar 12 Sep 15 - Brig R Vinayak, VSM (Retd)

There are individuals and unscrupulous agencies that are working in tandem to neutralise Armed Forces Veteran solidarity on OROP. There is news being spread around that the Veteran organisations are divided / split on post OROP announcement stand of veterans. The dubious elements are spreading misinformation and unfounded lies to the environment. Some elements have also spread doubts about the captioned Rally. 

I have personally spoken to IESM functionaries and confirmed that Mega Ekata Rally at Jantar Mantar New Delhi on 12 Sep '15 will be held at all costs. I appeal to all veterans of Madhya Pradesh to be united and not fall prey to propaganda campaign against IESM who have sincerely been working in the best interests of Armed Forces veterans towards grant of OROP. Therefore, please pass on this message to maximum veteran friends and families and motivate them to join Mega Ekata Rally at Jantar Mantar New Delhi on 12 Sep '15 (Saturday) from 10:00 am to 3:00 pm.

Fulfilment of OROP dream - Gp Capt VK Gandhi, VSM

Dear Members,

Happy Janmashtami to all. UFESM is happy to announce that this Janmashtami has brought Good News of sanction of OROP for ex-servicemen.

Fifth September 2015 is a very auspicious day when our fight for OROP, 30 year old demand, has at-last been approved by the NDA Govt. Initially in 2008 ESM started the fight for OROP with the Govt and planned many rallies to communicate to Government that Armed Forces Personnel and Ex-servicemen are being given raw treatment in Independent India. IESM organised many rallies in last six years to convince all political parties that ESM need to be given OROP and need solution for some of their difficulties like medical attention, war memorial and ex-servicemen commission. UFESM was formed in June 2015, to unitedly put up fight for OROP. It is the effort of UFESM that OROP dream has has come true.

UFESM Thanks Prime Minister; UFESM sincerely thanks Prime Minister Sh Narendra Modi ji for taking personal interest in OROP and ensuring approval of OROP on 5 Sept 15.

Last minute insertion of a clause of VRS surprised ESM all over India and subdued our celebrations. This planted a suspicion in mind of ESM about the real/hidden intent of bureaucrats.  This issue was never discussed in any meeting between Government representatives and UFESM. It seems that someone in the Government is not happy with approval of OROP for ESM and has inserted VRS clause to derail OROP for ESM. UFESM feels that there is a need to fix responsibility for this faux paus.  This has resulted in changing Jubilation into cautious optimism by ESM. However this issue was clarified by RM Sh Manohar Parrikar to UFESM delegation in meeting in the evening on 5 Sep 2015. He confirmed that VRS is not applicable to ESM and Armed Forces Personnel and hence all personnel taking PMR will be entitled for full OROP. UFESM is thankful to Prime Minister of India Sh Narendra Modi ji for clarifying this in the speech on 6 Sep 15 at Faridabad. He assured ESM that someone is misleading the ESM by inserting the clause of VRS in the declaration of OROP. There is need put all doubts to rest that OROP is applicable in full to all ESMs (including ORs, JCOs and officers). He further confirmed that he has lot of love and respect for ESM and ESM will get full benefit of OROP as announced by RM. Respected Prime Minister sir ESM all over India reciprocate this feeling and affirm their respect for PM. 

However there are some minor issues which need to be attended on priority for OROP to be fully functional.
  • Government has recommended  fixing of pension based on mean of max and min of basic pay of the year; This arithmetic defeats the basic definition of OROP as it will lead to one rank and many pension and hence is not acceptable to ESM. There will be very minimal expenditure to Government on this issue.
  • Periodical pension equalization has to be one year whereas Govt  has announced it to be five years thereby completely distorting the OROP definition. Government has recommended that this issue will be referred to a single judge committee to adjudicate the period of pension equalization. UFESM is of the opinion that committee should consist of five members out of which three should be from ESM and one serving soldier under the chairmanship of a judge. This report should be completed in fifteen days or max one month. 
  • MOD must confirm the date by which the Government letter will be issued. Agitation and RHS will be called of only after receipt of Government letter. Our experience with bureaucrats has been less than satisfactory because ESM had been shortchanged on many occasions in language of the order. Latest experience being that of Rank pay issue.  
In view of clarification given by honorable PM  that VRS is not applicable to Armed Forces, Fast unto death has been discontinued. All eleven ESM on fast unto death for last 24 days were referred to RR hospital and Rockland Hospital qutab institutional area for medical examination. However RHS and agitation will continue till issuance of Government order for OROP. 

Col Inderjit Singh, Lt Gen Balbir singh and Maj Gen Satbir singh has provided sterling leadership to lead the campaign to make dream of OROP a  reality. All ESM salute their dedication and hard work.   

This agitation has lasted for 84 days and FUD has lasted for 24 days. The agitation has been going on in over 80 towns across India. The agitation has been very peaceful and has never caused any inconvenience to civil order. Human rights of India has accepted that this agitation has been very disciplined and has recommended for this years prize. 

Maj Gen Satbir singh has been invited by NRI of USA to visit San Frisco on 18 Sep in view of sterling leadership provided by him in planning and conducting this agitation. He has been invited as special guest to San Frisco to coincide with the visit of PM of India.

UFESM has called for a Gaurav Rally at 1000h to 1500h on Saturday 12 Sep 2015 at Jantar Mantar to 
  • Celebrate realization of our dream of OROP. 
  • Thank Government in fulfilling their promise. 
  • Remind Government to iron out the minor problems and issue Government order within 15 days or latest by 30 Sep 15.  
ESM from all states are requested to attend the rally in large numbers.

  • Rockland Hospital for conducting medical examination of ESM on fast unto death. Dr Col Bheemwal needs a special mention as he had been sending a team of doctors everyday morning to check the ESM on FUD. He had been himself coming every day evening to check the ESM on FUD. 
  • Dr Ankit Om and his friends for providing medical cover to ESM on FUD. 
  • Bangla sahib Gurudwara and Gurudwara Rakabganj for providing accommodation to ESM visiting Delhi for participating in the agitation. 
  • Delhi Gurudwara Prabandhak Committee for providing langar to supporters visiting JM in large numbers. 
  • All ESM, NDA courses, Regiments  for contributing with open heart to support the agitation. 
  • All ESM for providing break fast at JM,  Col Ashok Malhotra's contribution needs special mention as he had been instrumental in coordinating with various agencies to provide breakfast. 
  • Col Alexander CEO Metro Multimedia Technologies (Digital) for providing banners for making stage for agitation. 
  • A team of volunteer ESMs who had selflessly worked in managing all activities at JM, without them management of this agitation would not have been possible. 
  • Many veterans of importance who had been helping in arranging meetings at short notice with RM and FM.
