 Dated 29th June 2016

OFFICE MEMORANDUM

Subject: Implementation of 7th Pay Commission Recommendations – revision of Central Civil Pension Cases.

A large number of pension cases would be due for revision consequent to the implementation of 7th CPC recommendations. Revision of such large number of cases would not be possible in short span of time unless the same are done electronically under digital signatures of the PAOs. Further, this will also streamline and make all future revision process digital & efficient.

2. To meet the requirement of pension revisions through digitally signed revision authorities, a system is under development/testing by CPAO. In this system, digitallly signed Revision Authorities will take place of the physical revision authorities so far being received from PAOs. For signing these authorities, digital signatures of all the PAOs dealing with pension cases and their registration in CPAO website would be required. CPAO had already requested all the Pr.CCAs/CCAs/CAs/AGs and Administrators of UTs vide its OM.No.CPAO/Coor/(99)/2015-16/1018 dated-21.12.2015 followed by OM.No.CPAO/Coord/(99)/2015-16/1048 dated 12.01.2016 (Copies enclosed) for obtaining of digital signatures of all pension processing PAOs. However, progress in this regard has been very slow and still many PAOs have not obtained the digital signatures.

3. In view of above, all Pr.CCAs/CCAs/CAs/AGs and Administrators of UTs are requested to review the status in this regard and arrange the digital signatures for the remaining PAOs urgently latest by 5th July, 2016 to avoid any inconvenience at later stage. As soon as the testing of system is over, step by step process of digital signature registration on CPAO website and schedule of training on the new system for PAOs/AAOs and dealing hands will be intimated.

4. Pr.CCAs/CCAs/CAs/AGs and Administrators of UTs are further requested to certify the availability of digital signatures for their all pension processing PAOs under their login in CPAO website.

Dated: 21st December 2015
OFFICE MEMORANDUM
Sub: Arranging Digital Signature for the Pension Processing PAOs for sending online digital authorities to CPAO
CPAO is is process of implementing e-PPO project whereby digitally signed authorities would be received in CPAO from the PAOs of the Ministry/Department both in fresh pension cases as well as revision cases. For signing the e-authorities, PAOs would be required type-II digital signature key. In this regard, necessary instructions were issued by the PFMS Cell, Office of CGA, M/o Finance vide OM No.C-13015(370)/MF.CGA/PFMS/Meeting/2015-16/1757 dated 08/12/2015 (Copy enclosed) to all the Pr.CCAs/CCAs/CAs (with independent charge) to arrange the digital signature for their pension processing PAOs (as per list attached).
In view of implementation of 7th CPC recommendations related to pension, around 11 Lakhs pension cases would need to be revised by CPAO. Manual processing of such huge number of cases would be time taking which may lead to delay in payment to the Pensioners. Therefore, for speedy revision, it is desired to process these cases in e-mode by the PAOs and send them electronically under their digital signatures to CPAO. For this purpose, Digital Signatures of Pension Processing PAOs would be required.
It is, therefore, requested to urgently arrange the digital signature for all the pension processing PAOs of your Ministry/Departments latest by 8th January, 2016 and a confirmation report may be sentt to CPAO.

Payment of difference of Gratuity to pre-1996 Central Government Pensioners

No. 38/42/2005-P&PW (F)
Government of India
Ministry of Personnel, PG& Pensions
Department of Pension & Pensioners' Welfare

3rd Floor, Loknayak Bhawan
New Delhi-110003
Dated 17th February 2005

Office Memorandum

Subject:           Payment of difference of Gratuity to pre-1996 Central Government Pensioners - clarification regarding.

            The undersigned is directed to say that a number of representations have been received seeking confirmation whether in pursuance of Supreme Court Judgement, vide this Department's OM No. 45/86/97-P&PW (A) Pt. I dated 04.12.2004; pre-1996 pensioners have been made eligible for receiving additional gratuity. They have asked the concerned pensioners to apply to their respective Departments by furnishing details of PPO number, date of retirement, Bank details etc. It also contains a portion of the OM purported to have been issued by this Department but does not indicate the name of Officer under whose signature it has been issued.

2.         In view of the above, the factual position in the matter is as under:

(i)         This Department has not issued any OM on 4.12.2004 granting additional gratuity to pre-1996 pensioners as there is no such Supreme Court Judgement in that respect; and

(ii)        The extracts of OM reproduced by them purported to have been issued on 4.12.2004 is in fact a portion of this Department's OM dated 4.12.2001 bringing out certain modifications to OM dated 27.10.1997. In that OM, the Government consequent upon acceptance of the 5th Pay Commission recommendations, inter-alia, prescribed that 100% of DA be added to the pay and on this the retirement/death gratuity be calculated. This was made effective from 1.1.1996. It did not change any provisions regarding percentage on DA for those who retired before 1.1.1996. Vide OM dated 4.12.2001 the Government clarified that the addition to DA for calculation of gratuity would be applicable for calculation of all types of gratuities like death/ retirement/ service gratuity. In this OM also there is no change in other provisions of OM dated 27.10.1997 including the cut-off date of 1.1.1996. This was further clarified vide para (ii) of OM dated 18.2.2003. Hence, prior to 1.1.1996, only basic pay was reckoned as emoluments for computation of gratuity. It has not been agreed to extend the benefits to retirees prior to 1.1.1996 as for grant of any benefit, prescription of a cut-off-date is essential keeping in view various constraints including financial constraints.

CPAO requests all Pensioners associations to get in touch with Pre-2006 Pensioners for providing details while providing life certificate which are required for Revision of Pension

Dated: 30.10.2015
Office Memorandum
Subject :- Revision of pension of pre-2006 Central Civil Pensioners and providing better service to pensioners.
Consequent upon the implementation of 6th CPC, revision of pensions of Pre-2006 pensioners were made suo-moto by banks as per ready reckoner provided by Deptt. of Pensions & Pensioners Welfare w.e.f. 01.01.2006. For regularizing these revisions and updating the records of Pension Sanctioning Authority, Pay & Accounts Office and Central Pension Accounting Office; Pension Payment Orders (SSA) were to be issued through proper channel i.e. Head of Office-> PAO-> CPAO->Bank. But considerable number of pension cases are still pending for revision by Government for want of certain information like last pay drawn, scale of pay, qualifying service, date of birth, date of death, current pension account number, contact number etc. which are not readily available either with Pension Sanctioning Authority or with the Banks.
As the recommendations of the 7th CPC are due very shortly, it is imperative to settle all these pending cases before so that while implementing the recommendations of 7th CPC, pension may be revised expeditiously.
In this context, it is presumed that the Central Civil Pensioners’ Associations remain in touch with pensioners and they may facilitate in pursuing the pensioners to provide their latest addresses, telephone numbers, e-mail le while submitting their Life Certificates (Format of Life Certificate enclosed) to the bank in the month of November, 2015 so that the pensioners may be contacted to get the required information.
In view of the above, Secretaries of all Central Civil Pensioners’ Associations are requested to extend their support in making contact with pensioners and pursue them to provide the necessary information while submitting Life Certificates to enable us to serve them better.

Subject:-Modification in the format of Life Certificate -Issue of Acknowledgement to pensioners.

Attention is invited to this office OM No.CPAO/Tech/Simplification/2012-13/325 dated-18.02.2013 directing the banks to allow pensioners/family pensioners to submit the life certificates as well as other certificates to any branch of the bank through which their pension are being disbursed. In this context, several instances of stoppage of payment of pensions have been reported citing non-receipt of life certificate even though the pensioners had submitted their life certificates to the bank, due to misplacement of the life certificate at the bank branches concerned. Instances of some pension paying banks not accepting life certificates given to them by pensioners and directing pensioners to submit the life certificate to CPPC have also been reported causing great inconvenience to pensioners, which results in either stoppage of payment of pension or delay in payment of pension.

In this context, to alleviate the hardship faced by the pensioners, RBI has also instructed all the Agency Banks handling government pension payment, vide Notification No. RBT/2014-15/ 587 DGBA. GAD No. H-5013/ 45.01.001/2014-15 dated-07.05.2015 that on receipt of life certificate submitted in physical form, banks to issue duly signed acknowledgement to the pensioners and to enter the same in their CBS immediately and issue a system generated receipt to serve the twin purpose of acknowledgement to the pensioners as well as real- time updation of records.

To facilitate the bank authorities, CPAO has prescribed a modified format of life certificate providing therewith acknowledgement of the receipt of the life certificate vide Correction Slip No.24 to the Scheme for Payment of Pensions to Central Government Civil Pensioners by Authorized Banks. The acknowledgement is a part of the format of Life Certificate, which can be detached and given to the pensioner by the receiving bank. The format (Annexure) has been circulated to all concerned and the same has been made available on CPAO’s website ‘www.cpao.nic.in’ at the link
“For Banks”–> Guidelines for Master data.

The Chairmen/Chief Executive Directors of Authorised Banks are requested to ensure that their paying branches follow the above instructions scrupulously without fail.

O R D E R

The applicant has preferred this Original Application for the following reliefs:
“8(i) Summon the entire relevant record from the possession of respondents for its kind perusal;
8(ii) Upon holding that reducing the basic pay of the applicant as Rs.19960/- is bad in law, command the respondents to calculate all retiral dues and pension of the applicant on the basis of the last basic of Rs. 20,410/-

 8(iii) Direct the respondents to revise the pension, DCRG, leave encashment, commuted value of pension and pay arrears of the aforesaid amount with 18% interest p.a.;
8(iv) Direct the respondent to repay the amount of DCRG of Rs.43,790/- to the applicant with 18% interest;
8(v) Any other order/orders, direction/directions may also be passed.
8(vi) Award cost of the litigation to the applicant.
8(vii) Set aside the order dated 30.10.2012 (Annexure A/1), order dated 6.8.2012 (Annexure A/2) and order dated 4.4.2012 (Annexure R/7) with all consequential benefits.”

2. The learned counsel for applicant submitted that at the time of retirement, applicant was holding the post of Deputy Post Master, Khandwa Head Office in the Pay Band of Rs.9300-34800/- + Grade Pay of Rs.4600/- and his basic pay was Rs.20,410/-. However, while paying him retiral dues, the basic pay has been reduced from 20,410/- to 19,960/-. Further, Rs.43,790/- has been deducted from his DCRG, without assigning any reason. The applicant was inducted in the cadre of HSG (II) in the pay scale of Rs.5000-8000 and posted as Deputy Post Master at Itarsi Head Office. Thereafter, vide the order dated 12.1.2005, the applicant was sent on deputation to work as Sub Post Master, Harda in the cadre of HSG (I) and he was given the pay scale of Rs.6500-10500/-. Appointment of applicant in the cadre of HSG (I) was approved by the Departmental Promotion Committee (DPC) and orders were issued on 18.8.2005 (Annexure A-3). Thus, there is no justification for reduction of pay of the applicant for retiral benefits and deduction of Rs.43,790/- from DCRG.

3. The respondents, in their reply, have submitted that the applicant was promoted to HSG (I) grade vide the order dated 18.8.2005, Before that, vide the order dated 12.1.2005, he was posted on HSG (I) grade post of Sub Post Master, Harda Head Post Office by Senior Superintendent of Post Offices, Hoshangabad. Since the applicant was working at that time with the office of Sr. Superintendent Post Offices, Hoshangabad, there was no ground for posting him on deputation basis in one of its offices. Thus, applicant was not entitled to the pay of HSG (I) grade on this posting at Harda as he was still in HSG (II) grade. In any case, applicant was promoted to HSG (II) grade on 29.10.2004 and had qualifying service of only two months as on 1.1.2005 in that grade, he could not have been promoted to HSG (I) grade so early as the qualifying service of three years was required for such promotion. Therefore, when his pension case was prepared, there was objection in regard to his pay fixation on 17.1.2005 in HSG (I) grade when he joined at Harda in compliance of order dated 12.1.2005 of SSPO Hoshangabad. Therefore, applicant’s pay was accordingly refixed and he was grated HSG(I) grade w.e.f. 23.08.2005 when he was actually promoted to that grade. Thus, due to correction of his pay fixation w.e.f 17.1.2005, his basic pay at the time of retirement was changed and applicant has been paid retiral benefits accordingly. Further, excess salary paid to him during this period has been recovered from the DCRG. Thus, the OA, being without any merit, deserves to be dismissed.

4. Heard the learned counsel for the parties and perused the pleadings of the respective parties and documents annexed therewith. I have also gone throught the writtern arguments filled by learned counsel for the respondents.

5. It is undisputed that the applicant was promoted to HSG (I) grade vide the order dated 18.8.2005 (Annexure A-3). Before that, he claims to be posted on deputation basis on a post of HSG (I) grade. However, the order dated 12.1.2005 (Annexure R-1) by which he was posted as Sub Post Master, Harda was issued by Sr. Superintendent of Post Offices, Hoshangabad and since the applicant was already working in his jurisdiction, this posting could not be considered as on deputation. In-fact, this is simply a posting order on vacant post of Sub Post Master, Harda on which the applicant was posted on his own cost for which he may have requested at that time. Thus, applicant was not entitled to get the pay scale of HSG (I) grade w.e.f. 17.1.2005 on the basis of order dated 12.01.2005 (Annexure R-1). Therefore, respondents are not at fault in re-fixing his pay, by treating him promoted to HSG (I) grade w.e.f. 23.08.2005. In view of this correction, basic pay of applicant has been revised and applicant has been paid all the retiral benefits based on this pay. Thus, the respondents cannot be faulted in granting retiral benefits to the applicant based on his revised basic pay of Rs.19,960/- in place of Rs.20,410/-, and no interference with the orders of respondents in this matter, is justified, Therefore, the prayer of the applicant in this regard is rejected.

6. So far as deduction of Rs.43,790/- from the DCRG of the applicant is concerned, this amount has been deducted without issuance of any show-cause notice to the applicant. Relying on the judgment of Hon’ble Supreme Court in the matters of State of Punjab and others etc v. Rafiq Masih (White Washer) etc., Civil Appeal No. 11527 of 2014, learned counsel for the applicant submitted that in view of the law laid down by the Hon’ble Supreme Court in that order, no recovery of excess payment can be made from retired employees or employee who are due to retire within one year of the order of recovery. Since recovery of excess salary has been done after retirement of applicant, such recovery is not in accordance with law. Therefore, the respondents are directed to refund Rs.43,790/- deducted from DCRG of the applicant, within a period of 60 days from the date of communication of this order. However, no interest shall be payable on that amount.

7. Thus, the O.A is partly allowed. No order on costs.
