Disproportionate Possession of Assets

New Delhi: Mere possession of disproportionate assets to known sources of income is not an offence and a person can be held guilty only if it is proved that the assets were acquired through illegal means, the Supreme Court observed on Wednesday.

“Disproportionate assets is not a crime. It is only a crime if it is proved that the source of the money is illegal, then only the offence is complete, otherwise, it will be an inference only," Justice Amitava Roy observed, while a bench of Justices P C Ghose and Amitava Roy hearing an appeal against the acquittal of Tamil Nadu CM J Jayalalithaa in a Rs 67 crore disproportionate assets case.

The observation came when senior advocate Dushyant Dave, appearing for Karnataka, described the High Cour judgment as “perverse beyond imagination.”

Dave, who challenged the acquittal, told the bench that the High Court verdict was "perverse" as it "committed error" in calculating the CM's assets.

He said the assets, expenditure and income of the accused was considered jointly and they couldn't make out a case for separate assessement now.

The bench said, "Suppose you prove all the accused are together and it is the same money of accused Jayalalithaa which was being circulated, does it lead to conviction? Will it mean the money...was from income obtained from unknown sources?"

FinMin seeks free access to PNR details for all depts to curb LTC fraud

New Delhi: The Finance Ministry sought all ministries and departments to have free access to the Indian Railways' passenger reservation data to check widespread fraud in Leave Travel Concession (LTC) and Travel Allowance (TA) claims made by central government employees.

Finance Ministry wrote to Railway Board Chairman A K Mittal about the problem with fraud LTC and TA claims.

In a letter addressed to Railway Board chairman A K Mittal, a Joint Secretary in the Finance Ministry, Annie George Mathew, has written that submission of bogus or forged rail tickets with LTC/TA claims was a common problem faced by the government.

Mathew requested the Railways to consider giving access to Passenger Name Record or PNR-related information to ministries and departments free of cost "in the overall interest of transparency and corruption-free government".

The development follows an audit report and subsequent letter from Additional Controller General of Defence Accounts (A-CGDA) A K Saxena, who found that 3,500 LTC and TA claims made by Indian Air Force (IAF) personnel, including 400 officers up to the rank of Air Commodore, were fake.

Saxena's report estimates the total fraud over the past five years to be around Rs 350 crore. Individually, the amounts seem petty but the fraud could affect promotions of several high-ranking officers as the auditor has recommended strict action against them.

The letters and the audit report of the Dehra Dun-based Principal Controller of Defence Accounts (PCDA) have been reviewed by the media like The Economic Times.

Saxena had earlier written to the railways seeking access to passenger records, but the national transporter had demandedRs 750 per PNR for the information.

It would cost CGDA about Rs 12.5 crore per year just to verify the PNRs of the 1.5 lakh LTC and TA claims it audits annually.

Now the Finance Ministry has sought free access to the information for all ministries and departments.The PCDA audit had found that in many cases tickets presented for reimbursement were fake and hotel bills were inflated or bogus.

In some cases where IAF officers took flights, they forged the signatures of the under-secretary of the civil aviation ministry. The ministry's approval is mandatory when officers fly airlines other than Air India.

Some people digitally altered the amounts on the tickets to show a higher fare than they actually paid. The auditors suspect there could be an organised racket, considering "the widespread forgery across all commands, involvement of large number of personnel from accounts branch, uniformity in methodology and use of information technology".

7th Pay Commission award from July 1

New Delhi: A Finance Ministry's official today said new pay scale for all central government officials and employees under the 7th Pay Commission award will be implemented from July 1, 2015.

The 7th pay commission recommendations' implementation could not have been timelier, some economic experts say. So when the world is plunging in recession, central government employees are busy counting their blessings along with the hard cash they will receive in August as arrears from January 2016.

The several central government establishments such as the railways, telecom, air force, army, CPWD, CRPF, DRDO, CISF, Income Tax, Survey of India, customs and excise, among others are in happy mood.

These would perhaps live up to the 'happy and prosperous' Diwali greeting. After all, they will get arrears as well as bonus ahead of festive season.

The 7th Pay Commission headed by Justice A K Mathur proposed the highest salary at Rs 250,000 and the lowest at Rs 18,000. The commission also recommended 14.27 per cent increase in basic pay, 23.55% overall increase in salary, allowances and pensions. The increase in allowances was recommended 63% while pension was proposed to rise 24%.

The previous Sixth Pay Commission had recommended a 20 per cent hike in basic pay which the government doubled while implementing it in 2008.

A 13 members Empowered Committee of Secretaries, led by cabinet Secretary P K Sinha was formed in January to review the recommendations of 7th Pay Commission before cabinet nod and the committee is likely to finalize its work on June 11.

The Empowered Committee of Secretaries is likely to reach the conclusion to propose 30 percent basic pay raise instead of 14.27 per cent, which was recommended by 7th Pay Commission. They are also mulling for doubling of existing rates of such allowances and advances, which has been recommended for abolition by the 7th Pay Commission, sources said.
