SPECIAL FAMILY PENSION TO LADIES WHOSE HUSBANDS HAVE DIED IN SERVICE
Dear Veterans / Family Pensioners,
An important mail received from Brig CS Vidhyasagar is shared as follows:

Ladies & Gentlemen,
1.   Instances have come to our notice that many ladies whose husbands died in service were informed that the death is not attributable to military service. This famous decision was conveyed by the medical authorities.
2.   But hon'ble Supreme Court does not go by the wisdom of these medicos. They ruled in their famous judgment of 2013 that any disability suffered by any soldier is attributable to military service.
3.   So such deaths in service are also attributable to military service. Such single ladies of all ranks from Sepoy to Gen are entitled for Special Family Pension. I am told AFTs have also given such judgments. Few single ladies who approached AFT got their pension enhanced from Ordinary family pension to Special Family pension.
4.   I have also been informed some single ladies are getting ordinary family pension when their husbands have died in wars or war like operations going on in J & K and North East. Such ladies are eligible to get liberalised family pension. The difference in pensions is given below to explain the differences.
    (a)  Last pay drawn of soldier              - Rs 20,000 pm
    (b)   Ordinary Family Pension              - Rs 20000 x 0.3 = Rs 6000 pm + DR
    (c)   Special Family Pension                - Rs 20000 x 0.6 = Rs 12000 pm + DR
   (d)  Liberalsied Family Pension            - Rs 20000 x 1    = Rs 20,000 pm + DR.
5.    Brig SKS Rana, VSM , President, TSEWA North and Central Zones has recommended such ladies should get death of their husbands attributable to military service and then they would automatically get Special or Liberalised Family pension as the case may be as explained above.
6.   All those ladies are requested to kindly furnish your personal particulars to me as per the format attched. Please down load the format, enter your details and then send it back to me. Do not enter your particulars in vertical i.e. in one Column as then I have to spend time to copy and paste which is time consuming.
7. TSEWA decided to file a legal case in AFT Delhi under title AFT - 2(c) Getting Special and Liberalised Family pension to single ladies. The legal fees is Rs 3,000 for single ladies of Officers and Rs 1,000 for single ladies of JCOs and OR. If President of TSEWA of States recommend some single ladies of Sepoy to Havildar are unable to pay even Rs 1,000, then TSEWA will pay from its reserve fund and such ladies need not pay a single rupee.
8.   Please do not allow loss of even one rupee if you are eligible. Fight for it and get it. TSEWA will help you to get it.

Those affected are requested to send me their (or relative's / close friend's email 📧 I'd) to enable me to send them Excel format as ATTACHMENT for filling in / getting details to process / project their cases through TSEWA.
